1Who we are & what this is
mineracks.cloud is a service operated by mineracks pty ltd, a company based in Brisbane, Queensland, Australia (“mineracks”, “we”, “us”). We rent prepackaged, open-source appliances — such as a turnkey BTCPayServer, a Nostr relay, LNbits and a Bitcoin/Lightning node — and browser-accessible Linux desktops, running on hardware we own and operate. By using mineracks.cloud you agree to these Terms of Service.
2Eligibility
You must be at least 18 years old and able to form a binding contract. You are responsible for complying with the laws that apply to you, including in your own jurisdiction. You must not use the service where doing so would be unlawful.
3Your account & keys
Your Nostr key is your account. There is no username or password we hold on your behalf, and no email or identity document is required to sign in. This means:
- You are solely responsible for keeping your Nostr secret key safe. If you lose it, we cannot reset it or recover access to your account for you.
- Anyone who controls your key can control your account. Treat it accordingly.
- You are responsible for everything done under your account.
4Payment in Bitcoin
Prices may be shown in a fiat currency for convenience but are charged in bitcoin, typically over the Lightning Network, at the exchange rate applied at checkout. You may pre-fund a balance in satoshis and/or be metered per hour, depending on the product.
- Bitcoin payments are final and irreversible. There are no card networks and no chargebacks.
- Except where a refund is required by law, or offered by us at our discretion, payments are non-refundable.
- You are responsible for any taxes that apply to you.
- Bitcoin transactions are recorded on public networks. You are responsible for your own transaction privacy.
5Acceptable use
You agree not to use mineracks.cloud to:
- break the law, or host or distribute unlawful content;
- infringe anyone's intellectual property or other rights;
- attack, disrupt, gain unauthorised access to, or overload any system or network, ours or anyone else's;
- send spam or operate services that harm the wider network; or
- attempt to break out of, tamper with, or abuse the isolation of your instances or our platform.
We may suspend or remove anything that breaches this section, and we may cooperate with lawful requests from authorities.
6Your data & sovereignty
The whole point of mineracks.cloud is that your instances are yours. Payment appliances such as BTCPayServer are non-custodial — you hold your own wallet keys and we never take custody of your funds. You control the data on your instances, and you are responsible for your own backups.
We access the contents of your instances only where reasonably necessary to operate, maintain or secure the platform, to provide support you ask for, or where required by law. How we handle information is described in our Privacy Policy.
7Open-source software
The appliances we provision are third-party open-source projects, provided to you subject to their own licences and “as is”. Bitcoin, Lightning, Nostr, Ark, BTCPayServer, LNbits, Immich, Nextcloud and other names are the marks of their respective projects and are referenced descriptively. mineracks.cloud is independent and is not endorsed by them.
8Availability
mineracks.cloud is an early-stage service. We aim for high availability but do not offer a formal uptime guarantee at this stage. We may perform maintenance, and we may change, add or discontinue appliances and features over time. We will try to give reasonable notice of material changes that affect you.
9Disclaimers
To the maximum extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure against every threat. Nothing in these terms excludes rights you have under the Australian Consumer Law or other laws that cannot lawfully be excluded.
10Limitation of liability
To the maximum extent permitted by law, mineracks will not be liable for indirect, incidental, special or consequential loss, or for loss of profits, data, or funds (including bitcoin), arising out of or in connection with the service. Where our liability cannot be excluded but can be limited, our total liability is limited to the amount you paid us for the service in the three months before the event giving rise to the claim.
11Suspension & termination
You may stop using the service at any time. We may suspend or terminate access if you breach these terms, if required by law, or if necessary to protect the platform or others. On termination, unused prepaid balances may be forfeited to the extent permitted by law, and instances may be shut down and removed — so keep your own backups and move your keys and data out in time.
12Changes
We may update these terms as the service develops. The “last updated” date above shows when. Continuing to use mineracks.cloud after a change means you accept the updated terms.
13Governing law
These terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that state, without affecting any consumer rights you have under the law that applies to you.
